Services

By accessing and making use of services offered on FunForACause.ca (the “Website”), you (The User) are agreeing to be bound by to the following Terms and Conditions of this user agreement. The Website is an information and communication platform created to assist Causes and Charities in their fundraising efforts. The Website is provided on an “as-is” and “as-available” basis. The Website was created in, and primarily offers its services in the Province of Ontario, Canada, and in the event of a dispute, the laws and statutes of Ontario shall apply.

Auctions:
The Website attempts to create an enjoyable and fair real-time/live silent-auctions platform for the purpose of fundraising money for Causes, as submitted to the Website by users. By bidding on an item, the User must accept the risk that bids are binding, their bid could be the highest, and must commit to paying the amount that they bid. The User must also accept that they could be outbid by other users, and not receive the item.

Raffles:
The Website provides a medium for communicating the items available, raffle time, raffle winners, and facilitation of raffle ticket sales. The Website is not a licensed Electronic Raffle provider for conducting Raffle draws. By buying a raffle ticket, the User must accept the risk that their ticket number may not be a winner, and still commit to paying for the ticket price owed.

School Fundraisers:
The Website provides an e-commerce platform for Schools to promote their school fundraising initiatives, and make it easy to collect and manage order information and payments.

Privacy Policy

User information is collected, used, stored in accordance with our Privacy Policy.

Causes

The Causes and Charities on the Website are chosen by users of the Website, and do not necessarily represent the views of The Website or its creators. The Website is not a registered Charity, but some of the Causes on the Website may be a registered Charity. The Website reserves the right to limit or deny service on the Website to Causes or Fundraisers that do not successfully complete the Cause approval process, or are found to not be aligned with the good-natured spirit of the Website. If you would like to request use of the Website for your Organization, Cause or Charity, please complete a Fundraiser Request.

The Website does not provide Tax Receipts, but it is possible that Tax Receipts may be available by the chosen Cause, if they are a Registered Charity, and the amount paid for an item exceeds the market value (for clarity, please contact the Fundraiser Organizer or Charity directly, or read up on the Canada Revenue Website).

Order Cancellations or Changes

If a User wishes to change or cancel an order already placed for a Fundraiser, the procedure will depend on the Fundraiser Organizer's ("Partner Org") own policies. The Website may provide technical assistance on modifying orders or refunding held funds (if applicable). Please contact the Fundraiser Organizer ("Partner Org") for details, or use our Contact Form to request technical assistance.

Using the Website for your Fundraiser

If you would like to make use of our website to raise funds for your own Partner Organization or Cause, we offer 2 tiers for our Services:

FREE - We make our Services available free-of-charge, so your Cause can receive maximum proceeds! We are primarily a community-supported Website, therefore e-commerce transactions completed on the Website will include an option for users to voluntary give an amount to support the Website.
Premium - There may be an upfront fee, with the amount depending on the scope of the project. Web pages will be branded with your own logo, and you can choose a custom URL handle (e.g. https://funforacause.ca/YourFundraiser).

Other Fees: For credit-card transaction, online payment processors charge a processing fee (something like 2.9% + $0.30). Users completing a purchase using credit-card may be given an option to cover this fee, thus allowing the chosen Cause to receive the total proceeds for the purchase.

Payment Remittance: Payments collected by the Website for your Fundraiser will be held until after the completion of the Fundraiser. Funds will generally be transferred to your Partner Organization and/or your Cause, via an agreed upon method (e.g. Cheque, e-Transfer, ETF), within two weeks following the completion of the Fundraiser.

Limitations

Under no circumstances will the Website (or its owner) be liable for any damages relating directly or indirectly to any action or inaction based on the content, information, products or services or other material available through the Website. Users are responsible for paying any dues incurred in a timely manner. The Website shall not be liable for any User financial loss by mistakes made by the User or other users. Fundraiser Organizers are responsible for the delivery of goods or services offered through the Website. The Website shall not be made liable for any goods or services offered on the platform that are delayed or lost. Fundraiser Organizers are responsible for the timely transfer of money raised on the Website to the designated Cause or Charity.

Third parties may provide information displayed on the Website. The third-party information displayed on the Website is not necessarily sponsored, endorsed, recommended, or licensed by the owners of the Website.

The Website grants you a limited license to download and display on your computer monitor, or hard copy prints, the Website’s content, for non-commercial, personal or educational purposes only, providing that the Website content is not modified and that the Website's copyright statement is included with, and displayed on, each printed copy of such content. You may not display the Website's content on any other website or make available the Website's content on any file server.

Intellectual Property

The Website owns all rights, including all copyright, in the entire content of the Website. Unless otherwise indicated, no right, title or interest is granted in the content, information, products or services or other materials available through the Website. The names of all other products and services mentioned on the Website are the trademarks or trade-names of their respective owners.

Contact Form

The Contact Form (at https://funforacause.ca/Contact) is only to be used for legitimate business use, and is not to be used for spamming or trying to sell goods or services (e.g. SEO, capital funding). Violations of this use, may result in permanent banning from the Website without notice, or reporting your IP address to your Internet Service Provider.

Amendments

As the Website grows and expands, these Terms of Service are subject to change. The User may not be Emailed about changes to the Terms of Service, but the User will always be able to view the updated Terms of Service on this web page (https://funforacause.ca/Terms).
